WHY, AS A LAWYER, I WILL NEVER USE A SELF-CHECKOUT LANE

We have all been there: a quick run to the store for three items, a line of twenty people waiting for a single cashier, and an empty bank of self-scanning kiosks beckoning with the promise of speed.

It is tempting. But as an attorney who also practices in criminal law, and who has seen how the sausage is made in the retail loss-prevention and criminal justice pipeline, I walk past the self-checkout every single time.

Here is why:

1. The Strict Liability Trap of “Retail Theft”

In the eyes of the law, retail theft requires intent. But in the reality of modern loss prevention, the threshold between a genuine mistake and a criminal charge has become razor-thin.

When you use a self-checkout, you are performing the duties of the store’s employee without the training, the tools, or the legal protection. If a barcode fails to scan, an item stays in the bottom of the cart, or a produce code is entered incorrectly, the system flags it. To an algorithm or an eager loss-prevention officer watching a monitor, a scanning error looks identical to shoplifting.

2. The Shift from Customer Service to Accusation

In a traditional checkout lane, a cashier handles the transaction. If an item is missed or double-scanned, it is a shared human error corrected in real-time with a quick apology or an extra swipe of a card.

At a self-kiosk, you bear 100% of the procedural liability. If something goes wrong, the burden of proof shifts uncomfortably fast. Store security often bypasses the presumption of innocence, detaining shoppers first and asking questions later. Explaining that you “simply missed a scan” on a busy Tuesday afternoon is an uphill battle once the police are called and a report is generated.

3. Protecting Your Professional Reputation and Record

For everyday consumers, a retail theft misunderstanding is a nightmare. For licensed professionals attorneys, executives, healthcare providers, and fiduciaries” an arrest or a misdemeanor charge for retail theft can trigger catastrophic collateral consequences. It threatens professional licenses, security clearances, and hard-earned reputations, all over a $5 item that failed to register properly.

Final Word

Convenience is not worth the risk of automated accusation. By choosing a staffed register, I ensure a transparent transaction, a clear paper trail, and the human oversight necessary to prevent a simple errand from turning into a legal defense case.

Efficiency is great, but due process is better. I’ll wait in the line.
