Mediation is a process of resolving disputes or conflicts between two or more parties with the assistance of a neutral third party, known as a mediator. The following are some key factors that can contribute to a productive mediation:

Preparation: A well-prepared mediator and parties can contribute to the success of the mediation. The mediator should have a thorough understanding of the issues and the parties’ interests, concerns, and goals. Similarly, the parties should be prepared with relevant information, documents, and a clear understanding of their positions.

Open communication: Effective communication is essential for mediation to be productive. Parties should be encouraged to communicate openly and honestly with each other and the mediator and to actively listen to each other’s perspectives and concerns. Again, this is the “key” component.

Active participation: Parties should actively participate in the mediation process, engage in meaningful discussions, and work towards finding mutually acceptable solutions.

Flexibility: Mediation requires flexibility and a willingness to compromise. Parties should be open to exploring various options and be willing to consider alternatives to their original positions. I cannot stress this enough. It is the linchpin.

Respect: Respectful communication and behavior towards all parties involved in the mediation are essential. This includes respecting differences in opinions and being open to understanding and considering different perspectives.

Patience: Mediation can be a lengthy process, and parties may need to exercise patience and perseverance to reach a successful resolution.

Commitment: Finally, parties should be committed to the mediation process and willing to work towards finding a mutually acceptable resolution. A positive attitude and a willingness to compromise can go a long way in achieving a productive mediation.
