PLEASE TELL ME ABOUT THE FLORIDA LEMON LAW

In Florida, the Lemon Law applies to new or demonstrator vehicles sold in the state. If your new car has a defect or condition that substantially impairs its use, value, or safety, and the problem occurs within the first 24 months or 24,000 miles (whichever comes first), you may be eligible for relief under the Florida Lemon Law.

Here are some key points to consider:

Attempts to Repair: The law requires the manufacturer or its authorized service agent to have made a reasonable number of attempts to repair the vehicle. If the defect persists after a reasonable number of repair attempts, you may be entitled to relief.

Notification: You must provide written notification to the manufacturer, through its authorized service agent or dealer, about the problem and give them a final opportunity to fix the issue.

Manufacturer’s Obligation: If the manufacturer fails to correct the defect within a reasonable number of attempts, they are obligated to replace the vehicle or refund the purchase price, less a reasonable amount for use.

Filing a Claim: If you believe your vehicle qualifies under the Lemon Law, you may need to file a claim with the Florida Office of the Attorney General, which oversees Lemon Law disputes. Consult with an attorney or contact the Attorney General’s office for guidance on the specific steps and requirements.

It’s important to note that the Lemon Law may not cover issues that are the result of abuse, neglect, or unauthorized modifications to the vehicle. Additionally, the law applies to new or demonstrator vehicles used for personal, family, or household purposes.

If you’re facing issues with your new car, it’s advisable to consult with an attorney who specializes in Lemon Law cases to understand your rights and options. Keep detailed records of your repair attempts, communications with the manufacturer or dealer, and any other relevant documentation to support your case.
